Under section 369 of the Environmental Protection Act 1994 a person must hold an approval from the local government to carry out waste management works.
The objective of this requirement is to ensure environmental nuisance or harm is not caused as a result of carrying out this activity.
Waste management works is defined as:
- Remove, collect, transport, store, heat or dispose of waste
- Clean streets
- Clean and remove waste from sanitary conveniences, or
- Provide a place, containers or equipment for depositing of waste.
Removal of green waste for mulching and reuse is not considered a waste under the Environmental Protection Act 1994 as it has a beneficial use other than disposal to landfill.
If you are carrying out waste management works for a fee or reward, you are required to obtain an approval with Townsville City Council. Fill out the application form and return to council along with the associated fee.
